Can landlord evict me over support dog?

////Can landlord evict me over support dog?

Question

My landlord is trying to get me evicted because she is saying that my dog can't be a support animal because it is a Pit Bull.

Answer

According to the Department of Housing and Urban Development (HUD) Notice issued in January 2020, “Pet rules do not apply to service animals and support animals. Thus, housing providers may not limit the breed or size of a dog used as a service animal or support animal just because of the size or breed…” I suggest you consult with a Legal Services organization or a landlord/tenant attorney in your area. For a copy of the HUD Notice referred to above and for information on filing a complaint, see: https://www.hud.gov/sites/dfiles/PA/documents/HUDAsstAnimalNC1-28-2020.pdf. and https://www.hud.gov/program_offices/fair_housing_equal_opp/assistance_animals. State and local agencies may also be contacted, such as the Utah Anti-Discrimination & Labor Division. Good luck!
