People who believe that their animal is being wrongfully withheld can contact the police, although the police do not usually intervene in animal custody disputes. A civil lawsuit can also be commenced, such as an action in claim and delivery.

Courts may look at such things as who adopted/purchased the animal, who has been the animal’s primary caretaker, who has paid for the animal’s needs, who is the animal registered to, e.g., microchip, license and veterinary records. Some courts also consider the best interests of the animal.
