Question

I adopted a kitten from a very negligent shelter several months ago. I was promised multiple times that when they did the double enucleation that he was neutered. I have texts from the person who assisted with surgery that says he was neutered, he IS NOT neutered. What can I do?

Texas law states that with limited exceptions, “a releasing agency may not release a dog or cat for adoption unless the animal has been sterilized or the release is made to a new owner who signs an agreement to have the animal sterilized.” If there is an adoption agreement that states that an animal is neutered and the animal is not neutered, the adopter may have a claim against the shelter that made the misrepresentation (even if unintentionally) for the cost of the neutering procedure. Contacting the shelter before proceeding with litigation may help to more expeditiously resolve this matter.
