My son got rid of my dog while on an NCO.

I had an NCO from the State on my son. I could not return to my home for 3 weeks! My son and his girlfriend gave my dog away without my knowledge and permission. I am suing the person with my dog. Will the Judge give me back my dog?

I am very sorry to hear about your situation. I cannot predict how any given court will decide a lawsuit.
You stated in your inquiry that the “thief has had my dog longer than me.” Is it possible that the person who has the dog is not a thief and that he/she adopted the dog in good faith, not knowing all of the circumstances?
It is not clear from your inquiry what assistance, if any, you sought when you were not in the residence to care for your dog. Sometimes the police or other law enforcement officer, if requested, will remove a person’s dog if left at a residence where such person cannot go due to a domestic violation situation.
The court will consider the totality of the evidence, which may include what assistance you sought to get the dog and whet rights your son, and his girlfriend had to rehome the dog.
I hope this all works out in the best interests of the dog.
