My ESA has been withheld from me for 4 months.

Question

What can I legally do if my husband, that I am going through divorce from, stole two of my dogs that are both microchipped and one of them is my actual emotional support animal for my PTSD from the death of my baby. What are my legal rights? I know where he lives now. He is completely ignoring me. It is causing me extreme emotional distress and he is well aware.

Answer

California law states, in part: “The court, at the request of a party to proceedings for dissolution of marriage or for legal separation of the parties, may assign sole or joint ownership of a pet animal taking into consideration the care of the pet animal.” ‘Care’ is defined to include, but not be limited to, the prevention of harm or cruelty and the “provision of food, water, veterinary care, and safe and protected shelter.”

I suggest you consult with a matrimonial attorney in your area.
